PUBLIC NOTICE PREVENTS CONSUMERS AND OUR BRAND FROM BEING INJURED BY MISREPRESENTATION OF BRAND ALREADY PROTECTED BY UNITED STATES PATENT TRADEMARK OFFICE

1. Trademark Infringement (Lanham Act – 15 U.S.C. §1114, §1125(a))

Uses your registered trademark (like VA-BC®) without authorization, and

Offers the same or related services in the same field, and

Misleads consumers into believing they’re affiliated with or approved by you,

then that’s willful trademark infringement and false designation of origin under federal law.
You can pursue
civil damages, injunctions, and even treble damages if it’s proven willful.

2. Cybercrime & Online Misrepresentation

If the person or company uses your mark online — through a domain, website, social media, or email — to deceive the public, this can also violate federal cybercrime statutes, such as:

18 U.S.C. §1030 – Computer Fraud and Abuse Act (CFAA): if they gain access to or misuse digital systems (e.g., impersonating your site, copying content, or redirecting traffic).

18 U.S.C. §1028A – Aggravated Identity Theft: if they impersonate your organization or officers to gain money or data.

18 U.S.C. §1343 – Wire Fraud: if they use internet communications to sell services while misrepresenting their affiliation or authority.

18 U.S.C. §2320 – Trafficking in Counterfeit Goods or Services: applies when someone knowingly sells or advertises goods/services bearing a counterfeit mark.

Use of the VA-BC® trademark or any variation thereof without written authorization from VA-BC Training Center, LLC and its registered owners constitutes willful trademark infringement under the Lanham Act (15 U.S.C. §§ 1114, 1125(a)), and dilution by blurring or tarnishment under the Trademark Dilution Revision Act (15 U.S.C. § 1125(c)).

Unauthorized online use of VA-BC® or any derivative, including deceptive or impersonating domains, may also violate the Anticybersquatting Consumer Protection Act (15 U.S.C. § 1125(d)), and applicable federal cybercrime statutes (18 U.S.C. §§ 1028A, 1343, 2320).

Evidence of misuse, misrepresentation of affiliation, or fraudulent service offerings is being preserved and reported to the U.S. Patent and Trademark Office, Federal Trade Commission, and Federal Bureau of Investigation (IC3.gov).

Notice qualifies as a protected factual statement made in good faith to protect a federal trademark (under the Lanham Act §1114 & §1125).
